Please read these Terms of Service ("Terms") carefully before booking a charter or using the Hernando Beach Charters website. By booking a trip or using this Site, you agree to these Terms.

Charter Services

Hernando Beach Charters provides guided fishing, diving, spearfishing, and water-activity charters in the Gulf of Mexico and surrounding coastal waters. All charters are operated by USCG-licensed captains.

Participant Responsibility

By booking a trip, you represent that:

  • You and all members of your group are in good physical health and capable of participating in the chosen activity
  • You have disclosed any medical conditions, swimming limitations, or other factors relevant to your safety to us in advance
  • You hold all required licenses (Florida fishing license, certification cards, etc.) for your chosen activity
  • Guests under 18 must have written parental or guardian consent

Weather and Safety

The captain has sole discretion to cancel, shorten, or modify any trip due to weather, mechanical issues, or safety concerns. In the event of a captain-initiated cancellation, you will receive a full refund or the option to reschedule. Hernando Beach Charters is not responsible for travel expenses, accommodation, or other costs incurred in connection with a cancelled trip.

Liability Waiver

Participation in charter fishing, diving, spearfishing, and water activities involves inherent risks including but not limited to rough water, marine animal encounters, slipping on deck, and equipment failure. By booking, you acknowledge these risks and release Hernando Beach Charters, its captains, mates, and agents from liability for injury, illness, loss, or damage arising from your participation, except in cases of gross negligence.

A separate liability waiver will be provided at or before departure and must be signed by all adult participants.

Cancellation Policy

See our Cancellation Policy in the FAQ section or as presented during the booking process. Guest cancellations within 7 days of the trip date are generally non-refundable unless the slot is rebooked.

Alcohol and Conduct

Adults 21+ may bring alcoholic beverages on board in compliance with Florida boating laws. Guests who become impaired, disruptive, or create safety risks will be returned to the dock at the captain's discretion without refund.

Governing Law

These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in Hernando County, Florida.
